When is EPF registration mandatory?
EPF registration is mandatory for establishments employing 20 or more persons. However, establishments with fewer employees can also voluntarily register. Once registered, you cannot deregister even if employee count falls below 20.
 
 
For EPF: Employer contributes 12% of basic wages (3.67% to EPF + 8.33% to EPS). For ESIC: Employer contributes 3.25% and employee contributes 0.75% of gross wages for employees earning up to ₹21,000/month.
 
Non-registration attracts penalty up to ₹5,000 under EPF Act and imprisonment up to 1 year. For ESIC, non-registration can lead to penalty equal to twice the contribution amount plus interest at 12% per annum.
 
Yes, establishments with fewer than 20 employees can voluntarily register under Section 1(4) of the EPF Act with consent of employer and majority of employees. This is common for startups wanting to provide PF benefits early.
